Pursuant to Point l, Clause 1, Article 6 of Vietnam’s Investment Law No. 143\/2025\/QH15<\/strong>, effective from March 1, 2026<\/strong>, which prohibits the trading of electronic cigarettes and heated tobacco products, and in accordance with its product management policies for e-commerce platforms, Delivery K announces that we will no longer allow tobacco and related products to be listed or sold on our app in Vietnam.<\/strong><\/p>\n\n\n\n

This policy aims to ensure compliance with applicable laws and regulations, contribute to protecting consumer health, and promote a safe, responsible, and transparent e-commerce environment.<\/p>\n\n\n\n

This policy applies to all Partners currently operating on the Delivery K platform in Vietnam.<\/p>\n\n\n\n

1. Categories of Products No Longer Supported for Sale<\/strong><\/h2>\n\n\n\n

The following product categories will no longer be supported for sale on Delivery K:<\/p>\n\n\n\n

    \n
  • Traditional Tobacco Products:<\/strong> Domestically manufactured or imported cigarettes, cigars, loose tobacco, and traditional Vietnamese pipe tobacco (thu\u1ed1c l\u00e0o).<\/li>\n\n\n\n
  • Electronic Cigarettes:<\/strong> Vapes, pods, disposable electronic cigarettes, and refillable electronic cigarettes.<\/li>\n\n\n\n
  • Heated Tobacco Products:<\/strong> Tobacco products designed for use with tobacco-heating devices.<\/li>\n\n\n\n
  • Specialized Devices and Smoking Accessories:<\/strong> Electronic cigarette devices, tobacco-heating devices, and smoking pipes.<\/li>\n\n\n\n
  • E-Liquids and Specialized Consumables:<\/strong> E-liquids, vaping liquids, pod cartridges, and heating coils.<\/li>\n\n\n\n
  • Related Components and Accessories:<\/strong> Parts, components, and accessories specifically designed for assembling or using the products listed above.<\/li>\n<\/ul>\n\n\n\n

    This policy applies to all products within the above categories, regardless of brand, origin, or listing method.<\/p>\n\n\n\n

    2. Requirements for Partners<\/strong><\/h2>\n\n\n\n

    To ensure consistent implementation of this policy across the platform, Delivery K kindly requests all Partners to cooperate with the following requirements:<\/p>\n\n\n\n

      \n
    • Discontinue the Listing, Advertising, and Acceptance of Orders for Tobacco and Related Products:<\/strong> Partners must cease listing, offering, advertising, promoting, providing consultation on, or accepting orders for any products included in the prohibited categories on our application.<\/li>\n\n\n\n
    • Proactively Review and Remove Products:<\/strong> Review and remove all relevant products from storefronts, menus, and other content displayed on the platform.<\/li>\n\n\n\n
    • Comply with Product Listing Regulations:<\/strong> Partners must not modify product names, images, or descriptions, list products under incorrect categories, or use misleading product information to continue selling products that are no longer supported.<\/li>\n\n\n\n
    • Do Not Accept Orders Through Chat or Consultation Features:<\/strong> Partners must not use the application’s chat function, order notes, or other features to introduce, promote, provide consultation on, accept orders for, or arrange transactions involving the products listed above.<\/li>\n\n\n\n
    • Inform Relevant Staff:<\/strong> Communicate this policy to employees responsible for storefront management, sales, and customer service to ensure consistent compliance.<\/li>\n\n\n\n
    • Cooperate with Reviews and Necessary Adjustments:<\/strong> Cooperate with Delivery K’s relevant departments during the review, verification, and correction of any non-compliant content or activities.<\/li>\n<\/ul>\n\n\n\n

      Any continued listing or sale of these products, concealment of product information, or use of alternative methods to facilitate their sale will be considered a violation of the platform’s policies.<\/p>\n\n\n\n

      3. Monitoring, Support, and Enforcement Measures<\/strong><\/h2>\n\n\n\n

      Delivery K will strengthen its inspection, review, and monitoring activities across the platform to identify, prevent, and address violations.<\/p>\n\n\n\n

      Depending on the nature and severity of the violation, we reserve the right to take appropriate enforcement measures in accordance with our platform policies<\/strong>, including:<\/p>\n\n\n\n

        \n
      • Removal of Non-Compliant Products:<\/strong> We may independently remove or hide products, images, and content that violate the policy without requiring prior approval from the Partner.<\/li>\n\n\n\n
      • Cancellation of Non-Compliant Orders:<\/strong> We may reject or cancel orders involving products that are no longer supported for sale. For orders that have already been paid for, we will require the Partner to refund the Customer and retrieve the products (if already delivered) before processing the order cancellation in the system.<\/li>\n\n\n\n
      • Restrictions on Sales Activities:<\/strong> We may temporarily suspend or restrict the sales functions of non-compliant storefronts.<\/li>\n\n\n\n
      • Suspension or Termination of Storefront Operations:<\/strong> We may temporarily suspend or permanently terminate selling privileges on the application in cases of deliberate violations or repeated non-compliance.<\/li>\n\n\n\n
      • Cooperation with Competent Authorities:<\/strong> We may report relevant information to the competent authorities when activities suspected of violating applicable laws are identified and require further action in accordance with applicable laws and regulations.<\/li>\n<\/ul>\n\n\n\n

        We will take strict action against deliberate non-compliance, including listing prohibited products under alternative names, conducting transactions through the chat function, or misusing application features to circumvent platform controls.<\/p>\n\n\n\n

        For cases requiring further verification or adjustment, we will coordinate with the relevant Partners to provide appropriate support and assistance.<\/p>\n\n\n\n

        We kindly request all Partners to proactively review and update their storefronts and cooperate in implementing this policy to ensure smooth and compliant business operations on the application.<\/p>\n\n\n\n
